CHALLENGES IN PROTECTING THE COPYRIGHT OF BLOGGER-GENERATED CONTENT

In the context of the rapid integration of digital network technologies, blogging has evolved into an independent form of professional creative and economic activity. The outputs of this activity, manifested in content posted on social media, have de facto become significant assets in civil circulation; however, current Russian legislation provides no specific legal regulation for such assets. The purpose of this study is to identify the main strategies for improving the legal mechanism protecting bloggers’ copyrights. The research employs general scientific methods: analysis and synthesis were used to identify challenges within individual components of the blogger legal protection system and to integrate the findings into general conclusions. Through a systemic approach, blogging was examined as an element of the copyright legal framework, considering the interplay between substantive, procedural, and information-law regulation mechanisms. Furthermore, specific legal methods were applied: the formal-legal method was used to interpret current legislation and determine the legal status of blogger content, while the comparative legal method was utilized to examine foreign doctrines and regulations. Finally, the analysis and generalization of judicial practice allowed for the categorization of disputes in the blogging sphere and the identification of established legal precedents. Results: the study provides substantiated proposals for improving substantive and procedural legal regulation, including clarifying the limits of free use of works and the statutory consolidation of the obligations of information intermediaries.
