PROTECTION OF LABOR RIGHTS BY THE STATE LABOR INSPECTORATE AT THE PRESENT STAGE

In recent years, the legal regulation of the Federal Labor Inspectorate’s activities has undergone significant changes. Firstly, the emphasis has shifted from control (supervisory) activities to preventive ones; secondly, the grounds for conducting both planned and unscheduled control measures have been substantially limited. The purpose of the research is to examine the current legal regulation of the Federal Labor Inspectorate’s activities in protecting employees’ labor rights and to assess the effectiveness and accessibility of such protection. Methods: the formal-legal method was applied in the study of statutory materials. The comparative legal method made it possible to compare the current legal regulation of the administrative form of protection of employees’ labor rights with international standards. General scientific methods of analysis and synthesis, induction and deduction were applied to examine law enforcement practice, which enabled the formulation of original conclusions and proposals. The conducted research establishes that changes in the legal regulation of state control (supervision) in the sphere of labor have significantly reduced the effectiveness of the Federal Labor Inspectorate in protecting employees’ labor rights. The paper formulates proposals to bring current legislation on scheduled inspections into compliance with ILO Convention No. 81 and to reinstate the right of state inspectors to conduct inspections based on employee complaints about labor rights violations.
