Abstract

The effectiveness of national economic development and the quality of social program implementation directly depend on the efficiency of state property management, a significant element of which is state-owned shareholdings. Corporations with state participation in the Russian Federation generate a significant share of budget revenues, foster scientific and technological progress in priority sectors of the national economy such as the fuel and energy complex, transport infrastructure, mechanical engineering, metallurgy, etc., and implement specific socio-economic infrastructure development programs. It is evident that under such conditions, the modern model of state participation in the economy and its civil law framework require revision. The purpose of the research is to determine the effectiveness of legal regulation of the activities of business entities with state participation. This purpose is achieved through the following tasks: developing a definition and identifying the main characteristics of business entities with state participation, establishing their legal standing, and determining their place in the system of legal entities. Research methods: the historical-legal method enabled the identification of the problem of defining the status of a business entity with state participation and the classification of existing approaches in civil law doctrine in this area; the systemic approach formed the basis for identifying the characteristic features of the subject of law under consideration; using the formal-legal method, the current legislation of the Russian Federation was analyzed, and gaps in the legal regulation of the object under study were identified. Results: the article concludes that the mere participation of the state in the charter capital of a business entity does not create a new organizational and legal form. However, this situation calls for additional legal regulation, specifically the granting of special legal capacity to such entities.
