Abstract

The development of communication technologies has led to the active emergence of blogging, which, due to its mass appeal, has become one of the leading means of social communication, significantly contributing to the formation of public opinion. The absence of specific legal regulation regarding bloggers’ status in the current legislation poses a threat to individuals’ rights and lawful interests, as well as to public interests. The purpose of this study is to determine approaches to the establishment of bloggers’ legal status as a hybrid of private and public activity. Achieving this purpose involves addressing the following tasks: justifying the application of a subject-focused approach to defining bloggers’ legal status; identifying the essential characteristics of blogging activities; and establishing bloggers’ legal status based on a risk-oriented approach. Research methods: the formal-legal method identifies the problem stemming from the lack of legal regulation of bloggers’ status in the existing legislation and proposes approaches to its legal resolution. The linguistic method forms the basis for uncovering the semantic meaning of concepts used in the description of blogging. The comparative law method reveals specific features of the concept of “blogging activity” in foreign legislation. Results: the article concludes that it is necessary to form and differentiate bloggers’ legal status based on subject-focused (activity-based) and risk-oriented approaches.
