GUARANTEES OF PROPERTY OWNERS’ RIGHTS PROTECTION IN THE EXPROPRIATION OF LAND FOR STATE AND MUNICIPAL NEEDS

The relevance of the issue concerning the expropriation of land for state and municipal needs and the observance of property owners’ rights is dictated by several key factors: the necessity to balance private and public interests, uphold economic fairness, prevent abuses, among others. A comprehensive approach to such regulation is essential to ensuring appropriate protection and safeguarding of the owners of expropriated land plots. Purpose: to investigate the adequacy of legally prescribed guarantees for the protection of property owners’ rights during the expropriation of their property. Methods: general philosophical research methods (materialist and dialectical) are employed to identify issues related to the judicial protection of property owners’ rights. Structural-system analysis and synthesis methods are utilized to differentiate guarantees protecting property owners’ interests, to establish the significance of the institution protecting the rights of owners of land expropriated for state and municipal needs, and to examine judicial practices concerning the compulsory expropriation of land. Specific scientific methods (legal-dogmatic and interpretation of legal norms) reveal the exceptional nature of the expropriation procedure for public needs. Results: the article concludes that the guarantees for the inviolability of private property are insufficient when public interest is realized. Emphasis is placed on property owners’ vulnerable position during the expropriation of their assets. The article proves the inadmissibility of separating disputes over compensation for damages into distinct legal proceedings. The balance of interests of each party should be observed, adhering to the criteria of fairness and good faith.
