Abstract

According to official air quality monitoring data in the Russian Federation, the ecological situation is deteriorating. At the same time, the right to a healthy environment, of which air quality is a component, is one of the most important constitutional rights, along with the right to life and health. According to judicial statistics, the number of perpetrators brought to criminal liability for illegal air pollution is extremely low. Such a striking difference between the level of air pollution and the number of persons brought to criminal liability indicates real problems not just in criminal law, criminal procedure, and criminology, but also in forensics. Purpose: to identify the real problems of detecting illegal air pollution and propose forensic recommendations for their elimination. Methods: Statistical (used to analyze pre-investigation check materials that led to decisions to refuse criminal prosecution), survey (20 interrogators with experience in handling reports of crimes under Article 251 of the Criminal Code of the Russian Federation were interviewed), generalization and analysis (to identify forensic issues at this stage of preliminary investigation and develop scientifically based, practical recommendations to address them). Results: The article identifies key factors and causes of high latency in this category of crimes. Specific forensic recommendations are proposed to address the challenges of detecting illegal air pollution.
